# Terms of Service

## 1. Acceptance of Terms

By accessing or using the Mesa platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

## 2. Description of Service

Mesa provides a WhatsApp API gateway that enables developers and businesses to send and receive WhatsApp messages through a RESTful API. The Service includes session management, webhook delivery, message sending, and related developer tools.

## 3. Account Registration

To use the Service, you must create an account by providing accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to notify us immediately of any unauthorized use of your account.

## 4. Acceptable Use

You agree not to use the Service to:

- Send unsolicited bulk messages (spam) or promotional content without recipient consent
- Violate any applicable local, national, or international laws or regulations
- Infringe upon the intellectual property rights of others
- Distribute malware, viruses, or any other harmful code
- Harass, abuse, or threaten other users or recipients
- Violate WhatsApp's Terms of Service or Acceptable Use Policy
- Attempt to gain unauthorized access to the Service or its related systems

## 5. API Usage & Rate Limits

Your API usage is subject to rate limits based on your subscription plan. Exceeding these limits may result in temporary throttling or suspension of your access. We reserve the right to modify rate limits with reasonable notice.

## 6. Subscription & Billing

New organizations receive a free trial without a credit card. The trial length and current prices are published at [/api/billing/pricing.md](https://mesa.zambrite.com/api/billing/pricing.md). Paid plans are billed per billing period. You may upgrade, downgrade, or stop renewing at any time; access continues until the end of the paid period. Refunds are handled on a case-by-case basis according to our [refund policy](https://mesa.zambrite.com/privacy).

## 7. Data & Privacy

We respect your privacy and handle your data in accordance with our [Privacy Policy](https://mesa.zambrite.com/privacy). Message content is processed transiently and is not stored on our servers unless explicitly configured by you (e.g., message logging).

## 8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance windows will be communicated in advance. We are not liable for any damages resulting from service interruptions.

## 9. Limitation of Liability

To the maximum extent permitted by law, Mesa and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

## 10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service, engage in abusive behavior, or if your usage patterns negatively impact other users. Upon termination, your right to use the Service ceases immediately.

## 11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated terms.
